Proposal for a solution to prevent the events of 2020 and Jan 6, 2021

I propose an amendment to the constitution to prevent an election like that of 2000 and 2020.

Based upon living through two contentious elections, 2000 and 2020, and living though a close contentious election of 2016, I believe there is room in the constitution to provide for the challenge of electoral votes.

This proposal would add to this amendment:

AMENDMENT XII
Passed by Congress December 9, 1803. Ratified June 15, 1804.

The Electors shall meet in their respective states and vote by ballot for President and Vice-President, one of whom, at least, shall not be an inhabitant of the same state with themselves; they shall name in their ballots the person voted for as President, and in distinct ballots the person voted for as Vice-President, and they shall make distinct lists of all persons voted for as President, and of all persons voted for as Vice-President, and of the number of votes for each, which lists they shall sign and certify, and transmit sealed to the seat of the government of the United States, directed to the President of the Senate; -- the President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted; -- The person having the greatest number of votes for President, shall be the President, if such number be a majority of the whole number of Electors appointed; and if no person have such majority, then from the persons having the highest numbers not exceeding three on the list of those voted for as President, the House of Representatives shall choose immediately, by ballot, the President. But in choosing the President, the votes shall be taken by states, the representation from each state having one vote; a quorum for this purpose shall consist of a member or members from two-thirds of the states, and a majority of all the states shall be necessary to a choice. [And if the House of Representatives shall not choose a President whenever the right of choice shall devolve upon them, before the fourth day of March next following, then the Vice-President shall act as President, as in case of the death or other constitutional disability of the President. --]* The person having the greatest number of votes as Vice-President, shall be the Vice-President, if such number be a majority of the whole number of Electors appointed, and if no person have a majority, then from the two highest numbers on the list, the Senate shall choose the Vice-President; a quorum for the purpose shall consist of two-thirds of the whole number of Senators, and a majority of the whole number shall be necessary to a choice. But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States. [/b]


The proposal would be like this:

If the electoral vote of a state is suspected to be invalid, the Vice President will suspend the joint session of Congress and both houses return to their respective chambers for debate. Ample time for debate will be decided by House and Senate rules according to the rules of the House of Representatives and the Senate, in their respective houses. If the challenge does not pass the House or the Senate, the electoral vote will be deemed valid and be certified. If the challenge passes the House and the Senate, the electoral vote will be deemed invalid and returned to the state in which it came. The state in question will have (15) fifteen days to rectify the invalid electors through the state legislator rules and appoint new electors. If the state legislature, in special session, cannot agree on electors within said 15 days, then the electoral votes deemed invalid shall be valid and return to Congress for certification.

After debate and resolution has been done, the Vice President will then continue with the counting of the remaining electoral votes. After all valid votes are counted, the Vice President shall suspend the counting of electoral votes, until the (15)fifteen days have expired. Once the (15)fifteen days have expired, the Vice President shall call into order a joint session of Congress to continue with the counting of the electoral votes. The invalid States will then present Congress with their new electors and they shall vote. The Vice President will then ask again for objection. If there is no objection then the votes shall be counted. If there is an objection then the Vice President will suspend the joint session of Congress and both houses return to their respective chambers for debate. Then the process will repeat as before until a valid electoral vote is cast. The electoral vote can only be invalid twice, if the electoral vote is rejected a third time, then the house of representatives of the state in questions' legislature shall pick the president to carry that state.

During the debate and vote on a resolution of whether an electoral vote is valid or invalid, the right to filibuster shall be suspended and a simple majority will be required to validate or invalidate the electoral vote. The person having the greatest number of votes for President, shall be the President, if such number be a majority of the whole number of Electors appointed; and if no person have such majority, then from the persons having the highest numbers not exceeding three on the list of those voted for as President, the House of Representatives shall choose immediately, by ballot, the President.


With this as a constitutional amendment, we, the people can, if the need arises contest the election.

Other statues in both Federal and State law need to designed such that a fair and timely election can take place. These statues should embrace technology and make the election process fair, and speedy. With cooperation from all three, local, state and federal cooperation, elections would go on like they always have.

But this should be, in my view, a new Constitutional Amendment to control any anomalies that can occur in a free and fair election. We are not perfect, this is just an attempt to make it better.....just a thought.....what do you all think?

Well the next proposal would be harder that would be voter id based on state ids. Basically the state/drivers license would double as a voter id card to be used in local, state and federal elections. Using that data base to determine citizenship. That part would be tricky.

We absolutely need to do something And I think your suggestion carries a lot of weight. I'll have to read it more thoroughly later I'm short on time right now.

California and N Y give illegal aliens licenses.

And Colorado and I forgot to hixhnorher state! Democrat states and all republicans lectiona audited by other parties and not subject to democrats at voted in who as in cali are crooks!

Get rid of mail in voting, ballot boxes and early voting....If you have a vested interest in America and whats best for your country you will get off your ass and get down to your voting precinct on election day and cast your vote.

Too many illegals have drivers licenses. Fake ones are becoming a cottage industry.

Exactly. Most, if not all states have had absentee voting for a hundred years. Difference is you have to request the absentee ballot prove who you are and have a valid reason for not showing up at the polls.

However, with driver's license/state id, citizenship is a question that can be cross referenced for voter use. Just like underage is also used to buy cigarettes or alcohol. Just apply it to voting.

And I know, just like cigarettes and alcohol, fake ids will be made to cheat on the elections, however, if caught using a fake I'd, since it would be used for elections place a fine if up to 10years in prison and a fine if $100,000 dollars. And it could be easily enforced like they do with Commercial Drivers licenses. A false CDL has a very strict fine attached to it.

This would be the easiest implementation to achieve. Early voting is convenient, and there are ways to force people to follow the rules. However, the ballots for absentee and early voting should be in before polls open to vote in person.

Early and absentee voting makes it easier for rural communities to exercise their right to vote.

But if you live in the city, or suburbia, the convenience of the polls should be easier to vote in person rather than early or absentee. Early voting should only apply to those who live/hibernate in rural areas. And I'm talking areas where you need a four-wheel drive to get to regardless of weather.

There is nothing wrong with early voting. The process is the same as going on election day here in GA. You come in and present your ID. I work for the damn election board part time, they all know me and I STILL have to show my drivers license. We take it seriously in my county.
Mail in ballots should never be allowed. Absentee ballots are different. They are given to service members deployed overseas. Domestically, at least in all the states I am familiar with, you must request a ballot, prove your identity and give a valid reason why you cannot make it to the polls. This is where early voting really cuts down on the mail in stuff. When you have a couple of weeks prior to the election day to go vote, you have far fewer excuses.

Exactly. Mail in ballots should be prohibited. If you don't care enough to either vote in person or get an absentee ballot, why should you vote?
There are usually two years between substantive elections. You cannot tell me that in two years time someone cannot find a way to go to the issuing agency and get a free or very inexpensive ID. Shows you don't care much about voting if you have to do anything. Most people who are supposedly affected by "voter suppression" already receive some sort of government stipend that requires them to have ID suitable for voting, anyway.
