I would go with a sane person would think some one who would kill another would be acting insanely.
That person for all intents & purposes could be judged sane.

If some one kills a person (even if it is well planed) would not be acting sanely.
Just acting insanely should not be a sign of insanity.

To be judged insane one would need to display many signs of insanity.
