The problem with USA today is basically that the concept of Constitution has become a Religion for ignorance, this has a multiplier effect and ignorance becomes omnipotent.

Sorry about that distraction, the US has a Constitution and Australia has a Constitutional Monarchy which is the same as a Constitution but legality is not supported by a Bill of Rights, so we accept multiple previous judgments as vindication or conviction, in the US it's the Bill of Rights that gives legal certainty to enforcement of judgments presented by Courts and legislative bodies not the Constitution.

Australia doesn't have a Bill of Rights so our Courts are the oversight of Parliament.
US Courts should be the oversight of the Bill of Rights not the Amendments.
