Can it be a hate crime if the shooter in non binary ?

The alleged Q Club shooter is alleged non binary. If that is true how can it be a hate crime ? Like if a Black kills a Black, it cannot be a hate crime, right ? ?

I would agree with that, but I'm not trying to fill a narrative either.
Maybe it's just that 10cents of common sense I bought in the 90s that leads me to that very conclusion.

The crime was hateful.--One would have to be filled with hate to murder 5 people and injure 18 others in an unprovoked mass shooting. If you are unsure of calling it a hate crime could it at least be agreed upon that this was an act of terrorism .

One could say any murder falls into the category of hateful. Wouldn't one have to be filled with hate, (at least for the target,) in order to be able to intentionally take the life of another. Assuming motives is always tricky.

This time the shooter is alive and maybe through questioning there will be an answer . Why?

Why? It, as I said, is always tricky assigning motives. Even if this sorry excuse for a human being claimed he had reasons, and told law enforcement/judicial system what they are...can we just assume he's telling the truth. If you're willing to murder people in heinous/cold blood...lying probably wouldn't be much of a stretch. This creep's actions say enough for him to pay a hopefully very heavy price for this atrocity...no matter what his motive/how he would like to justify it. There is no acceptable motivation/justification for this kind of action. But I also think that these mass murders are so vile/horrifying...that decent people can't help but ask ...why? I'm just not sure we can believe the answer we get from the perpetrator.

Exactly. Any act of violence is a hate crime, except if you are a liberal snowflake.
