Thoughts on the Recent Supreme Court Decisions

Superficially, it would seem that the Supreme Court has taken a turn to the "conservative side", as pointed out by Mr. Barnett in the article cited at the bottom of this post.

But, consider the following:
“If logic and reason, the hard, cold products of the mind, can be relied upon to deliver justice or produce the truth, how is it that these brain-heavy judges rarely agree? Five-to-four decisions are the rule, not the exception. Nearly half of the court must be unjust and wrong nearly half of the time. Each decision, whether the majority or minority, exudes logic and reason like the obfuscating ink from a jellyfish, and in language as opaque. The minority could have as easily become the decision of the court. At once we realize that logic, no matter how pretty and neat, that reason, no matter how seemingly profound and deep, does not necessarily produce truth, much less justice. Logic and reason often become but tools used by those in power to deliver their load of injustice to the people. And ultimate truth, if, indeed, it exists, is rarely recognizable in the endless rows of long words that crowd page after page of most judicial regurgitations.

"The dark comedy that is the ‘Supreme’ Court, shrouded in deception, conspiracy, politics, and agenda driven desires; is but a tool of the ruling ‘elites,’ and the political class it controls. There are always underlying reasons for these decisions, and it rarely if ever, has anything to do with protecting the individual or the best interests of society. It always has to do with fooling the people, power, control, and gaining an authoritarian position over the population in favor of the ruling class."

George Carlin, (God rest his soul) sums it up quite nicely, with the following comment:

“Forget the politicians. The politicians are put there to give you the idea you have freedom of choice. You don’t. You have no choice. You have owners. They own you. They own everything. They own all the important land, they own and control the corporations that’ve long since bought and paid for, the senate, the congress, the state houses, the city halls, they got the judges in their back pocket, and they own all the big media companies so they control just about all of the news and the information you get to hear. They got you by the balls. They spend billions of dollars every year lobbying to get what they want. Well, we know what they want. They want more for themselves and less for everybody else. But I’ll tell you what they don’t want. They don’t want a population of citizens capable of critical thinking. They don’t want well-informed, well-educated people capable of critical thinking. They’re not interested in that. That doesn’t help them.”

I’d say it’s much worse than “taking a turn”
Toward the conservatives side.
The Court has been radicalized.
Dark money influences have stripped the court of any semblance of its former self.
How far are we from a dictatorship when
5 SC judges dictate Policy ?
And the Media drowns out All Dissent?

While the states are crafting new abortion laws and revising old ones, they need to keep in mind that it is hard to create a law with no punishment. Do we really want women who have abortions to rot away in jail......or are we content to just punish the doctors and others who assist in the performance of the abortion?

"The death of the national right to have an abortion" was never a matter that should have been decided on the federal level in the first place, which is the basis for the current SCOTUS ruling. C'mon Riley, are you not familiar with the 10th amendment - ‘all powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States or to the people’?

And, as to "hamstringing of state efforts to regulate guns", what part of the Second Amendment's "the right of the people to keep and bear Arms, shall not be infringed" do you not understand? Allowing people the right to defend themselves is a right under Natural Law, or Traditional Morality, or the First Principles of Practical Reason, that existed even PRIOR TO the creation and adoption of the Constitution.

You can thank Harry Reed and the Democrats for eliminating the filibuster for judges confirmation that has led, much to the Democrats chagrin, to a conservative court. That act alone is what led to more ideological judges. Compromise is no longer necessary. You reap what you sow. And now the Democrats want to eliminate the filibuster on everything else. Bad move unless you want to create chaos everywhere about everything.

The function of the Supreme Court is limited to deciding specific cases. The Roe decision legalizing abortion lasted 50 years. In the current case, four out of the nine justices agreed with the original Roe v Wade decision. The current decision could be reversed in the future with a change of justices on the court. When the Second Amendment gave people the "right to bear arms", there was no such thing as a "standing army" and the whole country was around 4 million people. In 1791 common guns included muskets and flintlock pistols. Laws are subject to interpretation.

The court once before affirmed slavery and the right of the Government to inter Japanese citizens. Those laws were fortunately changed. The Constitution is pretty straight forward. I suggest you read it along with the Federalist papers. All rights not enumerated in the Constitution go to the states to decide. Got it?

Got it. Based on the 14th amendment's "right to privacy" mandate, the Supreme Court in 1973 ruled (7-2) that unduly restrictive regulation on abortion is unconstitutional. Politically powerful right-wing legal groups have committed for decades to overturn Roe. The 2022 Supreme Court is now made up of a new conservative supermajority. The perfect time to overturn Roe (5-4) and decide the Right To Privacy mandate under the Constitution no longer applies to abortion. Do you get it? The Constitution is still pretty straight forward.

Roe and the 14th Amendment are anything but straight forward as it pertains to Roe. Actually the 1973 SCOTUS ruled that "restrictive regulations on abortions is unconstitutional" and then it proceeded to put restrictive regulations on abortions in the very same ruling. It contradicted itself from the get go which is one of the reasons why the ruling on Roe was flawed and got overturned. The court tried to find a compromise between privacy and right to life by writing legislation from the bench and the court went to far. Overturning Roe was a constitutional and legal question. Not a moral one.

Do you get it you indoctrinated imbecile? The Courts decisions have never been or should be a popularity contest. roe v Wade should have always been a states decision. There is no super majority. Roberts is at best a moderate. Go cry somewhere else. This never was a right to privacy issue.

Which is it? A republic or a democracy?

Seem to me that some red state presidential elections are going to be decided by state legislatures and we know what slate they will endorse.
