Ultimately this will be decided by the Supreme Court. The next step is to see that all of the seats on the Supreme Court are filled, in order to pass or fail these decisions.
This means that (All) Supreme Court judges, including Ruth Ginsburg are ready and able to hear this argument.

I must say, this is pretty damn smart on the behalf of our President!

Where is RBG anyway? Well we will soon find out.
