As Judicial Watch reminded us yesterday, former Secretary of State Hillary Clinton is still under FBI investigation over the use of her private email server. Now, we have this development from Lachlan Markay of the Washington Free Beacon–the madam secretary signed a nondisclosure form, which carried criminal penalties for any unauthorized disclosure of classified information:

A day after assuming office as secretary of state, Clinton signed a Sensitive Compartmented Information Nondisclosure Agreement that laid out criminal penalties for “any unauthorized disclosure” of classified information.
Experts have guessed that Clinton signed such an agreement, but a copy of her specific contract, obtained by the Competitive Enterprise Institute through an open records request and shared with the Washington Free Beacon, reveals for the first time the exact language of the NDA.

“I have been advised that the unauthorized disclosure, unauthorized retention, or negligent handling of SCI by me could cause irreparable injury to the United States or be used to advantage by a foreign nation,” the agreement states.

Clinton received at least two emails while secretary of state on her personal email server since marked “TS/SCI”—top secret/sensitive compartmented information—according to the U.S. intelligence community’s inspector general.

The State Department said in September that Clinton’s private email system, set up at her Chappaqua, N.Y., home, was not authorized to handle SCI.

Cheryl Mills and Huma Abedin, Clinton’s two top aides, also signed copies of the classified information NDA.

State Department staffer Bryan Pagliano set up that server in Clinton’s home. He also maintained it; Pagliano pled the Fifth regarding further information on the email system. Clinton also personally paid him for his services. Time and again we’re reminded that Clinton broke federal regulations with this email system. The 2009 National Archives and Records Administration regulation said that all electronic communications from government employees needed to be saved and stored by their respective agencies. That never really happened at the State Department (they did preserve some emails, but we're horrible at it) until recently. And by recently, I mean after news of Clinton’s secret server was revealed earlier this year. Former State Department spokesperson, Jen Psaki, said the preservation of emails from senior staff should be up and running by the end of 2016.

The FBI confirmed that this is a criminal investigation, which also includes whether the former first lady violated portions of the Espionage Act. In August, Clinton finally turned over the server to the Justice Department, where an analysis found that there was at least one attempt to wipe the server clean, along with over 300 emails that were f**gged for sensitive information. Communications from five separate U.S. intelligence agencies were found, and yes–the server was vulnerable to hacking. It was reportedly one of the targets for Russian-linked hackers. Oh, and to add more to this unprecedented State Department saga, Clinton’s chief of staff, Cheryl Mills, the one who also signed the NDA form, forwarded classified information to the Clinton Foundation…twice.

As many have said before, this isn’t a witch-hunt. Yes, Republicans have tons of political ammunition from Clinton’s self-inflicted wound, but it’s the Obama Justice Department investigating her. Additionally, do you remember that nauseating “enough about your damn emails” moment from Sen. Bernie Sanders, Clinton’s primary opponent, during the first Democratic debate last month? Well, he’s apparently had a change of heart. As Cortney wrote yesterday, he said, “Let the [FBI] investigation proceed unimpeded.”

This comes after Hillary’s B******i hearing, which saw her strengthen her position among Democrats, though her numbers on honesty and trustworthiness remain abysmal, especially with Middle America–who viewed her worse on those personal attributes questions after the October 22 hearing.

Last Note: By the way, all of that sensitive material was stored in a server housed in a bathroom closet in Denver, Colorado. Clinton needed to find a replacement for Pagliano concerning the maintenance of her private email system upon leaving the State Department. She chose Platte River Systems, which later discovered that Clinton's information was being stored in an off-site server operated by Datto, Inc. in Connecticut.

There was supposed to be proof about Obama on B******i and then that never showed up and then Issa stepped down and then there's supposed to be better investigation on Obama and that never happened and then the talk was stuff on Clinton and that never happened and then they got the email thing going on with promises of finding something really big and that never happened and then there was the big wait for the big Clinton hearing a few weeks ago and now Clinton survived and there are no charges and now this.

I bet it will be a big fat dud like the rest were.

Post something when someone gets arrested otherwise, it just is one failure after another. Boy cries wolf way too many times for me.

The facts are there. You liberals can't admit the facts or prosecute your own liberal darling. Delay, delay and delay. The facts and lawsuits are there in the FIOA requests. The whole Obama administration what a joke, delay delay and delay the inevitable.

One fact coming up is the Clinton Foundation and where is the 43 million dollars and the illegal IRS charges and fraud by both and the lack of independent audits. Cant hide from the legal issues and statutes.

What is really going to keep on dogging Hillary is the 33 thousand emails that are issues every week and the (649) confidential emails and growing . . .

The final nail in the Clinton candidacy will be the 1 to 2 billion accounting practices of the Clinton Foundation and the spinoff charities IRS accounting and missing 43 million dollars.

We conservatives control congress and haven't been able to impeach or censure BHO or HRC.

I doubt any of the hype you subscribe to will ever result in anything close to what promises keep being emailed to you.

UncleJesse-you are either being facetious or dishonest about congress' ability to impeach Obama. You can rest assured that the House of Representatives would impeach Obama in a heart beat but realize that the democrats in the Senate would never convict him. Therefore, it would be an expensive exercise in futility. If justice is served Hillary will be indicted as was Gen. Petraeus. Good Luck America !!!

Ricko, I've read you write this many times over the past six or so years and I'll believe it when I see it.

I think you are full of sh** because BHO keeps winning and winning all the while there are promises of impeachment and censure.

The last thing was k*****g Keystone Pipe line going down the drain. But just before that, there was a budget passed that was supposed to k**l Planned Parenthood and Obamacare. Before that, the Supreme Court was supposed to k**l Obamacare to those states that don't have their own exchange. Before that, etc, etc. BHO keeps winning and my conservatives just keep whining, all the time.

Biggest whiner is at the top of the GOP nomination poll. What have the rino's done? Nothing. Can't even stop Obama despite control of House and Senate. This is supposed to be a lame duck time but Obama is getting everything and we are getting nothing but more whining.
