Judge Blocks Obama's Amnesty Order

A federal judge late Monday temporarily blocked President Obama’s executive action designed to shield millions of immigrants from deportation.

U.S. District Judge Andrew Hanen wrote that 26 states that filed a lawsuit against the action would “suffer irreparable harm” without a preliminary injunction and that the constitutional question must be decided before the administration can move forward with its plans.

"Once these services are provided, there will be no effective way of putting the toothpaste back in the tube should Plaintiffs ultimately prevail on the merits,” Hanen wrote

The president’s executive actions on immigration, announced last November, would delay deportations for millions of undocumented immigrants and provide them with the opportunity to apply for work permits. The first part of those policies, the deportation delay, had been set to go into effect Wednesday. The rest are expected to begin later this year.

White House press secretary Josh Earnest said in a statement released early Tuesday morning that the policies are “consistent” with law and the precedent set by presidents over the last fifty years who have “used their authority to set priorities in enforcing our i*********n l*w.”

“The Supreme Court and Congress have made clear that the federal government can set priorities in enforcing our i*********n l*ws—which is exactly what the President did when he announced commonsense policies to help fix our broken immigration system,” he said. He added that the move would bring both economic and public safety benefits.

“The district court’s decision wrongly prevents these lawful, commonsense policies from taking effect and the Department of Justice has indicated that it will appeal that decision," Earnest said.

That appeal goes to the Fifth Circuit Court of Appeals, located in New Orleans. The court is closed Tuesday for Mardi Gras, but its website says that the court is available for “Emergency Matters,”

The lawsuit against the president claims he is overstepping the bounds of p**********l power and violating a clause of the Constitution that authorizes the president to “take care that the laws be faithfully executed.” In the view of those states, Obama’s move legislates where he should be enforcing.

Greg Abbott, the former Texas attorney general and current governor who led the challenge against the immigration actions, praised the decision in a statement released to the Houston Chronicle.

“Judge Hanen's decision rightly stops the president's overreach in its tracks," Abbott said. "We live in a nation governed by a system of checks and balances, and the president's attempt to by-pass the will of the American people was successfully checked today."

Twelve states and the District of Columbia defended the president’s policies in a “friend of the court” brief filed in January.

An official with the Service Employees International Union (SEIU) characterized the Texas judge who temporarily halted Obama's action as “out of touch.”

“This judge and his right-wing backers can't bend the law to their personal will. They stand on the wrong side of history and justice. The law is on the side of the president, who has broad authority to determine immigration enforcement policy,” SEIU Executive Vice President Rocio Saenz said in a statement.

“Immigrant families are not the enemy,” Saenz added. “We are confident that justice will prevail as this case moves through the court system and that the relief granted by the president will take effect to the benefit of millions of families.”

law of constitution. since when has i******s been allowed to stay at will in our country? where is that in the constitution. and since when did the master follow the constitution. he is trying to dismantle it. Hedon;t want any lame stuff like these poor souls have no where to go. Go homeand should not have in this country. Why don't you try going to another country out stay the time and have the balls to ask for all their citizens; rights. The democrats have all gone bonkers. It's nothing to do with these wetbacks for im sure they care nothing about them it's just thy want to please their master by agreeing with him. 8 U.S. Code § 1325 - Improper entry by alien

(a) Improper time or place; avoidance of examination or inspection; misrepresentation and concealment of facts
Any alien who
(1) enters or attempts to enter the United States at any time or place other than as designated by immigration officers, or
(2) eludes examination or inspection by immigration officers, or
(3) attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact, shall, for the first commission of any such offense, be fined under title 18 or imprisoned not more than 6 months, or both, and, for a subsequent commission of any such offense, be fined under title 18, or imprisoned not more than 2 years, or both.
(b) Improper time or place; civil penalties
Any alien who is apprehended while entering (or attempting to enter) the United States at a time or place other than as designated by immigration officers shall be subject to a civil penalty of—
(1) at least $50 and not more than $250 for each such entry (or attempted entry); or
(2) twice the amount specified in paragraph (1) in the case of an alien who has been previously subject to a civil penalty under this subsection.
Civil penalties under this subsection are in addition to, and not in lieu of, any criminal or other civil penalties that may be imposed.
(c) Marriage fraud
Any individual who knowingly enters into a marriage for the purpose of evading any provision of the i*********n l*ws shall be imprisoned for not more than 5 years, or fined not more than $250,000, or both.
(d) Immigration-related entrepreneurship fraud
Any individual who knowingly establishes a commercial enterprise for the purpose of evading any provision of the i*********n l*ws shall be imprisoned for not more than 5 years, fined in accordance with title 18, or both.

Excellent post! Maybe we should petition to have the law changed from a Fifty Dollar penalty for violating the law to Fifty Thousand per offense! Should stop the tide and needs to be enforced!
