Democrats Cannot Impeach Trump, and You Can’t Impeach Him After Leaving Office: Dershowitz

Harvard Law professor emeritus Alan Dershowitz said Democrats have virtually no chance of successfully impeaching and removing President Donald Trump before Inauguration Day on Jan. 20.

“The case cannot come to trial in the Senate. Because the Senate has rules, and the rules would not allow the case to come to trial until, according to the majority leader, until 1 p.m. on January 20th, an hour after President Trump leaves office,” Dershowitz said in a Fox Business interview on Sunday.

Dershowitz, who defended Trump during the Senate impeachment trial about a year ago, suggested that the Constitution does not allow for impeaching a former president.

“And the Constitution specifically says, ‘The President shall be removed from office upon impeachment.’ It doesn’t say the former president. Congress has no power to impeach or try a private citizen, whether it be a private citizen named Donald Trump or named Barack Obama or anyone else,” he said.

It comes as House Democrats have proposed articles of impeachment after Trump made a speech to protesters near the Capitol. Some critics have claimed Trump incited the crowd into violence before a group stormed the Capitol building.

Trump told the crowd beforehand that their protest shows “the kind of p***e and boldness that they need to take back our country” and “let us walk down Pennsylvania Avenue.” The president did not tell the protesters to breach the Capitol or commit acts of violence and later condemned them.

At one point, Trump told the protesters to “peacefully and patriotically make your voices be heard.”

Another Trump defender during the House impeachment inquiry, law professor Jonathan Turley, explained that impeaching Trump over his speech would set a dangerous precedent.

“When I testified in the impeachment hearings of Trump and Bill Clinton, I noted that an article of impeachment does not have to be based on any clear crime but that Congress has looked to the criminal code to weigh impeachment offenses,” he said in an opinion piece. “For this controversy now, any such comparison would dispel claims of criminal incitement. Despite broad and justified condemnation of his words, Trump never actually called for violence or r**ts. But he urged his supporters to march on the Capitol to raise their opposition to the certification of e*******l v**es and to back the recent challenges made by a few members of Congress.”

Meanwhile, Democrats and some Republicans have floated the idea of Trump’s cabinet invoking the 25th Amendment, which concerns succession of the vice president if the president dies, resigns, or is removed from office.

Housing and Urban Development Secretary Ben Carson, a member of his cabinet, dismissed calls to invoke the 25th Amendment.

“As a Nation we need to heal. I have not talked to anyone about invoking the 25th Amendment, and I am focused on finishing what I started in uplifting the forgotten women and men of America. It’s time to move toward peace. We are not each other’s enemies!” he wrote.

January 8, 2021. As a conservative political writer, which I’ve been for some time, Friday night had the weird feel of a surrealistic, conservative-thought-purging Kristallnacht.

First and most surreal, Jack Dorsey’s Twitter permanently banning the account of the President of the United States. Not for some singular awful thing Donald Trump did, said, or tweeted — but for what he might do, say, or tweet in the future. That is profound.

For that reason, Dorsey, in all of his smug, left-wing arrogance, said, in effect, “F**k you!” to 74 million Americans who supported and v**ed for Trump, “You don’t matter.”

But that was just the beginning.

As the day and evening unfolded, we learned that Google had suspended conservative-leaning Parler from its app store, pathetically citing an “urgent public safety threat” as its reason, and Apple had given Parler a 24-hour ultimatum to, in effect, clean up its conservative act. Coincidence? Not a snowball’s chance.

In a letter to Parler, Apple said, in part:

“We have received numerous complaints regarding objectionable content in your Parler service, accusations that the Parler app was used to plan, coordinate, and facilitate the illegal activities in Washington D.C. on J****** 6, 2021 that led (among other things) to loss of life, numerous injuries, and the destruction of property.

“The app also appears to continue to be used to plan and facilitate yet further illegal and dangerous activities.”

Apple further said, “to ensure there is no interruption of the availability of your app on the App Store,” Parler was required to submit an update and a “requested moderation improvement plan within 24 hours of the date of the message.”

Apple said if it did not receive an update from the company within that time frame, the app would be removed from the App Store.

A few hours later, Google issued a similar ultimatum telling Parler that its app’s listing in the Google Play store would be suspended until it implements a moderation plan that will address “this ongoing and urgent public safety threat.”

Parler CEO John Matze defiantly said his platform would not cave to the pressure.

“We will not cave to pressure from anti-competitive actors! We will and always have enforced our rules against violence and illegal activity. But we WON’T cave to politically motivated companies and those authoritarians who h**e free speech!”

“This is not an attack on Parler. This is an attack on our basic civil liberties and the right to free speech. They know that the most powerful thing in the world is your voice and 1A.”, Matze correctly added.

But there was more.

YouTube on Friday banned former Trump advisor Steve Bannon’s “War Room” podcast for violating its terms of service. The president’s former chief strategist’s podcast was live earlier Friday before being taken down by YouTube, Washington Examiner Breaking News Editor Daniel Chaitin tweeted.

In addition, the Post-Millenial’s Andy Ngô tweeted that conservative journalist Elijah Schaffer was banned from Facebook and Instagram on Friday following the Capitol hill r**t on Wednesday, about which, Schaffer reported from on the ground.

And finally, as reported by Washington Examiner, conservative activist Brandon Straka announced on Friday his #WalkAway page on Facebook has been removed.

“FACEBOOK has removed the #WalkAway Campaign and has BANNED ME and EVERY MEMBER of my team!!!” Straka, founder of the #WalkAway movement, tweeted Friday morning.

“Over half a million people in #WalkAway with hundreds of thousands of testimonial videos and stories is GONE,” he added. “Facebook has banned everything related to #WalkAway.”

Straka also included screenshots of messages from Facebook, including one that said the page was “removed for violating terms of use.”

Clearly, this was a planned, coordinated attack. Just as clearly, it was an ominous harbinger of more to come. In a word, conservatives, I’m afraid we ain’t seen nothin’, yet. As Friday evening continued to unfold, I found myself pondering the answer to one question:

Why are they so afraid of us?

Certainly, there are precedents. Lenin’s Russian Revolution and Mao’s Long March come to mind. Less historical but with similar implication, universities protesting if not banning on-campus speeches by conservative activists, such as Ben Shapiro, Ann Coulter, and others.

Again, why are they so afraid of us?

From Lenin and Mao, to America’s universities, to Jack Dorsey’s Twitter and Mark Zuckerberg’s Facebook, to CNN pressuring cable carriers to drop Fox News, what are those who seek to silence the voices of others so damn afraid of?

They are afraid of us because they are afraid of the t***h.

By that I mean they are afraid of the t***h destroying their narratives. Isn’t that the way it’s been throughout history? The first thing a totalitarian does is eliminate a free press. That, and execute intellectuals and free-thinkers.

America’s left-wing-agenda universities — and their left-wing students — desperately attempt to block free speech because conservative free speech is anathema to their left-wing agendas.

Dorsey, Zuckerberg, Google’s Sundar Pichai, and other Big Tech autocrats suppress conservative content because they view it as a threat to their support of so-called “progressivism,” which, ironically, “progressively” attempts to censor only speech it fears.

CNN seeks to see Fox News removed from cable because Fox News exposes CNN lies and biases, not to mention keeps CNN and MSNBC ratings in the toilet where they belong.

While those who fear us and seek to censor us will never admit it, they respect us — in an odd, ironic, and twisted way. They respect our ability to get their way — to disrupt their narrative. If they did not, they would not work so feverishly to silence us.

Oh, aren't you mixing apples & oranges? Trump has already been impeached & can be impeached again, especially since the House has a majority. Removed from office, probably not. But in 10 days, he's automatically removed.

Housing and Urban Development Secretary Ben Carson, a member of his cabinet, dismissed calls to invoke the 25th Amendment.

None sense. They have no right to doing that. Read the constitution. Professor Alan Dershowitz
explained it very clearly.

1. The case cannot come to trial in the Senate. Because the Senate has rules, and the rules would not allow the case to come to trial until, according to the majority leader, until 1 p.m. on January 20th, an hour after President Trump leaves office,” Dershowitz said in a Fox Business interview on Sunday.

2. Constitution says, Congress can only impeach a sitting president. Not after his term in office.

3. And if Pelosi does that, she is proven to be the nastiest woman that ever live on this planet earth. She is worst than a devil.

If they impeach Trump now, they can impeach you and me. He is a private citizen.
