Court rules Obamacare most subsidies illegal

The 2-1 ruling said such subsidies can be granted only to people who bought insurance in an Obamacare exchange run by an individual state or the District of Columbia—not on the federally run exchange HealthCare.gov.

"Section 36B plainly makes subsidies available in the Exchanges established by states," wrote Senior Circuit Judge Raymond Randolph in his majority opinion, where he was joined by Judge Thomas Griffith.

"We reach this conclusion, frankly, with reluctance. At least until states that wish to can set up their own Exchanges, our ruling will likely have significant consequences both for millions of individuals receiving tax credits through federal Exchanges and for health insurance markets more broadly."

In his dissent, Judge Harry Edwards, who called the case a "not-so-veiled attempt to gut" Obamacare, wrote that the judgment of the majority "portends disastrous consequences."

Indeed, the 72-page decision threatens to unleash a cascade of effects that could seriously compromise Obamacare's goals of compelling people to get health insurance, and helping them afford it.

However, the ruling does, and will not ultimately affect the taxpayer-fund subsidies the federal government issued to 2 million or so people through the 15 exchanges run by individual states and the District of Columbia,

The Obama administration is certain to ask the full U.S. Court of Appeals for the District of Columbia Circuit to reverse the panel's decision, which for now does not have the rule of law.

This looks like the ruling I was telling folks about 3-4 months ago. I believe the original law suit was called Halbig et al v. Sebelius.
This is much bigger than people think. In a nut shell what it is about is in the language of the law they had slipped in" subsidies will be offered to people signed up under a federal exchange created by their state" back when they were still trying to coax individual states into creating a state exchange.
31 States last I heard did not create federal exchanges and now their people will not get gov subsidies. On the other hand those who didn't cant be penalized for not signing up either.
They seem to be being rather vague about it so far but if I remember correctly that is what this is about . It will crush Obama care in 31 states.

I'm thinking that the subsidies that have been received by people in those 31 states will have to be reimbursed.

Sucks that Obama isn't a dictator, doesn't it?

The WH just issued announcement that they plan to ignore the ruling.

I don't know since I am retired but don't subsidies start in the coming tax year?

I wonder how this will work out when the insurance companies say "where's my money"? After all, until today there were a lot of people covered under the ACA. Someone owes someone lotsa bucks. I wonder what would happen if the insurance companies file a class action and slap the fed with a mechanic's lien?

Oh, the last figure I read said 36 states had not formed their own ACA state agency.

I heard Josh Earnest say just what you have said on Fox this morning. I wonder if the alphabet sites are playing that part of the story today.

They are willing to enforce any law they like and not others and have ignored many court rulings since Obama entered the show. This is another example of Obama thinking about the Constitution and other laws.

Our leaners aren't about to get involved in this one since they all seem to be such strong supporters of ACA. Some have probably done some reading in this thread but haven't got their words about Democrat talking points yet.
