Fed Appeals Court Overturns Death Sentence for Boston Marathon Bomber

A federal appeals court on Friday overturned Boston Marathon bomber Dzhokhar Tsarnaev's death penalty sentence for helping carry out the 2013 attack, which k**led three people and wounded more than 260 others.

The 1st U.S. Circuit Court of Appeals in Boston upheld much of Tsarnaev's conviction but ordered a lower-court judge to hold a new trial strictly over what sentence Tsarnaev should receive for the death penalty-eligible crimes he was convicted of.

A spokeswoman for U.S. Attorney Andrew Lelling said his office is reviewing the decision and will have more to say "in the coming days and weeks." A lawyer for Tsarnaev did not immediately respond to a request for comment.

Last month the U.S .Supreme Court cleared the way for resumption of federal executions. Three people have been put to death so far.

However, Tsarnaev'a fate has long remained in limbo, though he was sentenced to die back in 2015 for his role in the fatal April 2013 bombing.

According to South Coast Today, Tsarnaev’s lawyers in December 2019 argued in front of the First Circuit Court of Appeals in Boston. Their claim was that the death penalty ruling should be thrown out because their client couldn't hope to get a fair trial in Boston, the scene of the bombing.

Tsarnaev and his older brother Tamerlan sparked five days of panic in Boston beginning on April 15, 2013, when they detonated two homemade pressure cooker bombs at the marathon's finish line and then tried to flee the city.

Tamerlan subsequently died in a shootout with police.

Seems to me that life in prison is a worse sentence than the death sentence. Who wants to live their whole life in prison. What if he lives to 100? I bet it seems like a death sentence.

Who cares ? The America hating POS set bombs and k**led Americans. He needs to be executed. Since you do not have the stomach for it, crawl back into your shelter. One of the judges to be fair was a Reagan appointee. The other two were from your village i***t Barry the Obama.

Probably some other Liberal judge will one day release him.

The death sentence is the best sentence for this mass murderer. Who wants this scum back on the streets somewhere in the future murdering more Americans? And you never know with these l*****t judges who have a bleeding heart for criminals, like the demented demorat party, that they would throw his case out and let him walk. Put the a-whole islamist out of our misery and fry him.

Let me just remind you that the Boston Marathon bombing k**led 3 & injured 264. The Oklahoma City bombing k**led 168 (many children) & injured 680. It was far more devastating yet all this attending is focused on this kid? It was a tragedy but time to move on. We don't need any more fund raisers for Boston 1.

" Let me just remind you that " Timothy McVeigh was executed for the Oklahoma City bombing, as he should have. Terry Nichols should have also been executed. Nichols is sentence to 161 consecutive life terms. What a freaking stupid sentence. He can only serve one. Plus a moron like the Governor of California , could release him due to the C****a V***s. The difference in casualties between the murders at Oklahoma and Boston was not for lack of trying. It is not time to move on. It is time to punish those who k**l Americans.
