The equal enforcement clause insists all are treated equally under the law, so in this instance neither a wealthy man relieving himself next to his BMW stopped in a traffic jam or a wino pissing on a dumpster in an alley will be prosecuted. Beyond this there is great discretion in what a particular agency, officer or DA chooses to focus limited resources on. Frankly I would like to see much more focus on white collar crime. Especially that committed against the poor.
