Judge: Government Has No Right to Know Who Is a Citizen and Who Isn’t

The last two years have given us a stunning number of decisions from out-of-control federal judges who are more interested in #Resisting the Trump administration than they are in following the law. Between rulings blocking the Middle Eastern travel ban, rulings prohibiting Trump from barring t*********r individuals from the military, and rulings blocking the administration’s right to withhold funds from sanctuary cities, we are living in the Wild West of judicial activism.

But even with all that said, Tuesday’s ruling from U.S. District Judge Jesse Furman is a bridge beyond. Furman ruled that the Trump administration may not inquire as to the citizenship of Census respondents in 2020, a huge victory for Democrats who want to disguise the number of i*****l i*******ts currently living in the United States.

From the Associated Press:

In a 277-page decision that won’t be the final word on the issue, U.S. District Judge Jesse Furman ruled that while such a question would be constitutional, Commerce Secretary Wilbur Ross had added it arbitrarily and not followed proper administrative procedures.

“He failed to consider several important aspects of the problem; alternately ignored, cherry-picked, or badly misconstrued the evidence in the record before him; acted irrationally both in light of that evidence and his own stated decisional criteria; and failed to justify significant departures from past policies and practices,” Furman wrote.

Among other things, the judge said, Ross didn’t follow a law requiring that he give Congress three years notice of any plan to add a question about citizenship to the census.

The ruling came in a case in which a dozen states or big cities and immigrants’ rights groups argued that the Commerce Department, which designs the census, had failed to properly analyze the effect the question would have on households where immigrants live.

The judge did a nice job of couching her decision in terms that would make this appear as something other than left-wing pandering, but it should be noted that none of the issues raised by Furman were relevant to the case. The plaintiffs argued that Trump was trying to intentionally prevent i*****l i*******ts from participating in the Census, resulting in a population miscount that could allow the federal government to take back funds (and congressional representation) from areas with lots of illegal residents.

Judge Furman knew she couldn’t rule on such absurd grounds, so she found some procedural issues with which to block the question.

This won’t be the final say in the matter. The Supreme Court is scheduled to address this very issue in February. Hopefully they will reach a more sound legal conclusion.

That is ridiculous! Every group or organization should know who it's members are. Can you imagine any family or church or scouting organization or any other group that should not know who its members are?

It is only the left that comes up with these bizarre ideas. Citizens pay taxes, v**e and keeps the government running. Aliens are guests and should behave and act like guests. My father came from the old country and behaved as a guest even after he got his citizenship he was so grateful to be here. The left keeps trying to tear down this great nation and make it over as a fumbling Venezuela or other c*******t nation. Americans must remember our heritage and what our forefathers went through to create the most wonderful and greatest nation on earth.


What nation did the Europeans look to to save them during two world wars? It wasn't Russia or any Asian or South American countries!

Patriots must take a stand NOW and support our president or we may lose the good life we currently enjoy!

Why do you let them put cameras all over and what about them putting licence plate readers on our streets and hi ways .
Why did you let them put GPS in our cell phones do they can track us?

So far Trump has been the only president who has been willing to push hard for a border wall. Once he gets that, he will hopefully follow up by deporting i*****l a***ns who have no business being here. And mandating that the government conduct all its business in the english. And them implement e-verify so i******s can't get jobs here. All that would be a good start.

I thought this was reversing the removal of the census question on legal status, not adding something new.

B*****e . . . . I also had a grandfather who immigrated from Norway. He loved this country. It was those who came here legally, those who had sk**ls (in my grandfather's case he was a sk**led cabinet maker.) In so many of the cases of those who came from the old country, gave up their native tongue--they were not just "unsk**led laborers." Unfortunately, far to many of those who want to come here to better their lives, do not have any sk**ls that would bolster our country. They come with hands out, eager to be taken care of by the legions of hard working Americans. I agree with our President, we have among our own citizens more than enough "unsk**led workers," to fill jobs other than crop picking. We need, educated people who are highly sk**led to come here and WANT WITH ALL THEIR MIGHTS TO BECOME AMERICANS, and want to participate in the American way of life.

I absolutely feel that our nation has the right to know just how many i******s we have among us. The idea that this might make i*****l i*******t families uncomfortable is just preposterous.

Spot on Auntie Lulu! The hoards of immigrants (mostly illegal) who come into this country today have no intention of assimilating. From what I see they balkanize themselves into their own communities, where they continue to speak their native language, and continue in doing things their mother country's ways. Yet they somehow feel entitled to the generous social services offered by our government and make sure to obtain all those benefits.
I hope the SCOTUS takes up the matter, and rules that everyone has to declare their status. That would be a good start to identifying those i******s who refuse to toe the line about what it means to be an American citizen. And deporting those who refuse to assimilate.

Time for our recently updated SCOTUS to start earning their paychecks. This is a perfect case for them to weigh in on. My personal opinion is that it is beyond asinine to do a census without this question. That is all.

The Patriot Act was an executive order, Trump or in the past Obummer could nullify it. It gives the CIA the right to spy, kinda like the FISA court. Something I never understood because the F means foreign. If they can read our license (no car) good luck. The GPS is why I don't have a cell phone. There area few others G5 (your router)gives off radiation, TSA totally unnecessary-dogs can do the same job better. There are quite a few others.
