No, it was earlier than FDR. Supreme court judges used to travel a lot, and they needed more of 'em. For instance, the Dred Scott case was decided, not in DC, but in st. Louis MO. I'm too busy to look up the history right now, but there have been more than nine at some periods in our history. There may be a secret part of the Constitution that says that only Republicans can nominate and confirm more than nine, 'cause I can't find anyting in my copy about the number.

The really strange part of what Kevyn says is that it may take an amendment to increase from 9 to 11. That would take numerous years in that the Congress has to begin amendments with a 2/3 v**e in each house and then the state legislatures have to v**e for the amendment. I think he is listening to his leaders who help trolls think things up.
