McCarran Walter Act on immigration

Wouldn't it have been interesting if, at some point during the Presidential campaign,
one of the candidates had asked , "Oh, by the way, has anyone in Washington DC

ever heard of the McCarran-Walter Act of 1952?

I did not know of this Act until recently, but it has been a law for almost 65 years.

Here are the historic facts that would seem to indicate that many, if
not most, of the people we elect to work for us in Washington DC do
not have the slightest idea of what laws already exist in OUR country.

After several terrorist incidents were carried out in the United States,
Donald Trump was severely, criticized for suggesting that the U.S.
should limit or temporarily suspend the immigration of certain ethnic
groups, nationalities, and even people of certain religions (Muslims).

The criticisms condemned such a suggestion as, among other things,
being Un-American, dumb, stupid, reckless, dangerous and racist.
Congressmen and Senators swore that they would never allow such
legislation, and our President called such a prohibition on
immigration unconstitutional.

As Gomer Pyle would say, "Well, Surprise, Surprise!" It seems that the
selective immigration ban is already law and has been applied on several occasions.

Known as the McCarran-Walter Act, the Immigration and Nationality Act
of 1952 allows for the "Suspension of entry or imposition of
restrictions by the President, whenever the President finds that the
entry of aliens or of any class of aliens into the United States would
be detrimental to the interests of the United States.

The President may, by proclamation, and for such a period as he shall
deem necessary, suspend the entry of all aliens or any class of
aliens as immigrants or non-immigrants, or impose any restrictions on
the entry of aliens he may deem to be appropriate."

Who do you suppose last used this process?

Why it was president Jimmy Carter, no less than 37 years ago, in 1979,
to keep Iranians out of the United States.
But he actually did more. He made ALL Iranian students, already in
the United States, check in with the government. And then he deported
a bunch of them.

Seven thousand were found in violation of their visas, and a total of
15,000 Iranians were forced to leave the USA in 1979.

So, what say you about all of the criticism that Donald Trump received
from the Democrat Senators, Representatives and the Obama Administration?

Additionally, it is important to note that the McCarran-Walter Act
also requires that an "applicant for immigration must be of good
moral character and in agreement with the principles of our
Constitution."

Therefore, one could surmise that since the Quran forbids Muslims to
swear allegiance to the U.S. Constitution, technically, Muslims should
be refused immigration to OUR country

That was certainly an interesting time in history, hprinze. Thanks for reminding "US," of Carter and Reagan. I have to admit, Carter (D), did a heroic act by the now {purposely}associated "Islamophoebic" action. I believe it was about that time, "Imanutjob" {Ahmadinejad} stormed the American Embassy in Iran {1979}, captured 52 Diplomats and civilians, and kept them prisoners for 444 days; each day thinking it may {and being brutally convinced} be their last. I suppose there was nothing that "Jimmy" could do, but when Pres. Ronald Reagan (R), became POTUS, the "new Sheriff in town" {as Pres. Trump (R), will do} had the prisoners released THAT DAY!!! Those were the days, when America was "GREAT!!!" "MAKE AMERICA GREAT AGAIN!!!" GOOOOOOOOOOOO PRESIDENT-ELECT DONALD J. TRUMP!!! Now; "DRAIN THAT {RADICAL SECULAR LIBERAL "REGRESSIVE"} SWAMP!!!"

Just thought I'd add this little tid-bit before all the liberal Democrats start pointing their fingers and calling Republicans racist, etc. :
"...led by Democratic Senator from Nevada Pat McCarran and Democratic Congressman from Pennsylvania Francis Walter, expressed concerns that the United States could face communist infiltration through immigration and that unassimilated aliens could threaten the foundations of American life. To these individuals, limited and selective immigration was the best way to ensure the preservation of national security and national interests."
http://history.state.gov/milestones/1945-1952/immigration-act
Ahhh, back in the day when Democrats made sense and loved, valued and protected "the foundations of American life"...so glad we FINALLY have a president who wants to make America great again!!!

What makes you think he doesn't already know about it?

Remember how the wall would be legally impossible? Turns out it's already law:
https://en.wikipedia.org/wiki/Secure_Fence_Act_of_2006

Donald Trump did not get where he is by being a fool. I suspect he knows what he's doing, and that's what's so scary for so many people.

In any case, Muslims are not of good character and therefore precluded: "The law states that an alien is not of good moral character if he... has more than one wife..."

Problem solved.

Rob,

you have this backward... Carter expelled Iranians because of the hostages... Carter took a hard line in the talks, he got what we needed from Iran. The agreement for release was signed.. Jimmy Carter is the man who did the work, negotiated the agreement and signed for the release of the hostages.. Iran was PO... they delayed release until the first day of Reagan term as a slap at president Carter.. If you think the release of the hostages was great, thank Jimmy Carter.. The president who made it possible..

Good point Larry,

This is one of those items which got approved and then got funded.... Enough... am not clear if this only applied to the Cal/Arizona part (700 mi) or the full border. only 600 some mi were built..

The Secure Fence Act of 2006’s goal is to help secure America’s borders to decrease illegal entry, drug trafficking, and security threats by building 700 miles (1,100 km) of physical barriers along the Mexico-United States border. Additionally, the law authorizes more vehicle barriers, checkpoints, and lighting as well as authorizes the Department of Homeland Security to increase the use of advanced technology like cameras, satellites, and unmanned aerial vehicles to reinforce infrastructure at the border.[1] Congress approved $1.2 billion in a separate homeland security spending bill to bankroll the fence, though critics say this is $4.8 billion less than what’s likely needed to get it built.[citation needed]

Proponents of the bill believe that it will diminish vehicle transport of illegal immigrants, encouraging those who want to enter the country to pursue legal channels or cover potentially hundreds of miles on foot and overcome a difficult obstacle. This should decrease the number of apprehensions of illegal immigrants, by physically reducing their numbers. It could also diminish the illegal drug trade pouring into the US from Mexico as well as provide additional protection from terrorist entry into the country.[2]

Opponents of the bill argue that it is not an effective strategy to curb illegal immigration because the fence is not a continuous barrier and can be climbed over or dug under in some areas. They also argue that it could harm US-Mexico relations, disrupt the environment and natural migration of wildlife, as well as increase the danger and risk of illegal immigrants attempting to cross the border. Further, opponents argue that because of the increased risk of crossing the border, illegal immigrants who previously pursued seasonal work and then returned home may have to bring their families and live permanently in the country.[2]

Since construction of the wall began “apprehensions, a rough proxy for measuring illegal crossings, were down 18% at the southern border in 2008 and Border Patrol attributes some of that to the fence.[citation needed] But a report in May 2009 by the Congressional Research Service found "strong indication" that illegal crossers had simply found new routes.” [3]

On January 23, 2008 the 110th Congress introduced Reinstatement of the Secure Fence Act of 2008 (H.R. 5124). This bill called for Homeland Security to construct an additional 700 miles (1,100 km) of two layered, 14 foot (4 m) high fencing along the southwest border.[4] The bill died in committee and was never voted upon.[4]

By April 2009 Homeland Security had erected about 613 miles (985 km) of new pedestrian fencing and vehicle barriers along the southwest border from California to Texas.[5]

In May 2010, Senator Jim DeMint (R-SC) unsuccessfully reintroduced his “Finish the Fence” amendment for the second time, which would require Homeland Security to construct an additional 353 miles (568 km) of fencing along the US-Mexico border.[6]
