California Judge Blocks Implementation of Magazine Ban

U.S. District Judge Roger Benitez issued a temporary injunction against implementation of a California law passed last year that would have turned most of the state’s six million gun owners into criminals overnight.
Previous law banned high-capacity magazines (containing more than 10 rounds) but grandfathered in those owners who already possessed them. The new law repeals that exemption and punishes mere possession of the offending magazines with fines and possible jail time, starting on Saturday, July 1.
Said Benitez:
If this injunction [is not issued] hundreds of thousands, if not millions, of otherwise law-abiding citizens will have an untenable choice: become an outlaw, or dispossess one’s self of lawfully acquired property. That is a choice they should not have to make….
The State of California’s desire to criminalize simple possession of a firearm magazine able to hold more than 10 rounds is precisely the type of policy choice that the Constitution takes off the table.
What he’s referring to, of course, is the language contained in the Bill of Rights of the Constitution, specifically that of the Second Amendment: “A well-regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed.


A well-regulated liberal attempt shot down....My dear friends in CA can keep their 30 clips! May the South rise again!!!!!

Very perceptive and good use of commom sense.

The only reason the 'US Constitution' was written and instituted was to protect the states and the American people from the federal government, by declaring what the federal government is restricted to be able to do, in favor of what the states are allowed to do, and what no government is allowed to do to the American people. The 'US Constitution' protects only the American people, only from their own governments.

Any American that does not fear it's government, is a foolish American, because the 'Founding Fathers' had a great fear of their government, and is the reason they wrote and instituted the 'US Constitution', and to get it radified, they had to also include the 'Bill of Rights' as it's first 'Ten Amendments'. This was to make sure the American people would be completely protected from their governments.

Those 'Founding Fathers' feared that the federal government would perpetrate the same crimes on them, as the British government did against the colonists in America, and which our federal government has been doing today, ignoring our 'Bill of Rights', and this attempt to infringe on our 2nd Amendement through restrictions of our arms, is just more proof of that fact. Will the federal government's infringements on all our 'Bill of Rights' ever stop? This is the reason to fear our governments.

I agree with everything you said. But without getting this off topic(Gun clip size and gun control) I wanted to add a comment on another topic that your post brought to mind.
Those 'Founding Fathers' feared that the federal government would perpetrate the same crimes on them, >>> Excessive and unfair taxation<<<as the British government did against the colonists in America, and which our federal government has been doing today, ignoring our 'Bill of Rights', and this attempt to infringe on our 2nd Amendement through restrictions of our arms, is just more proof of that fact. Will the federal government's infringements on all our 'Bill of Rights' ever stop? This is the reason to fear our governments.

Wasn't that the main reason the south seceeded from the Union? The slavery issue was mainly a northern issue to justify their cause in that subsequent fight.

I would add one more comment. I have no real desire to own a gun or concealed carry. But I would never give up that right or ask our government for permission to own a gun. In my opinion, the main reason to own a gun is, sooner or later we're going to have to shoot the bastards and start over. I'll leave the term 'bastards' to each individuals interpretation.

You are correct again, but there were more than just the "taxation without representation" that the 'Founding Fathers' said violated their rights. There were also unreasonable searches and seizures, arrests without warrants, and many other's that is the embodiment of our 'Bill of Rights' which the British had violated just about all of them. This was the reason for the 'Founding Fathers' writing them into a 'bill', that ended up being a requirement to be included in the 'US Constitution' in order to get it ratified.

I don't condemn you for not wanting to own a gun or have a concealed carry permit, especially since you are well aware for the need for those rights. But you need to think and use some common sense, for if you are one who will fight the tyranny of a government that has usurped the people's rights, it may be too late at that time to be able to acquire that gun(s). And if you prepare and get a gun(s) before the need arises, that is also the time to get the concealed carry permit, because when the government does first start on it's course of tyranny and usurping our rights, that ability to acquire that concealed carry permit will be the first to go too.

If you do decide to get a gun(s), be sure to get some training for how to properly handle and use them, as I had gotten when I served 4 years in the USMC.

I said I don't want to own a gun. I didn't say I do or don't have one. As for concealed carry permits and general gun license, when the coming revolution happens, where do you think the authorities are going to go first to confiscate guns. Block by block. I'm old enough that I might not live that long, or be able to actually fight when it happens. But if you are younger, be prepared and never declare all of your guns, even if you are a registered gun owner. Keep them save and well hidden. Stay safe and prepared.

Does anyone around here remember when the Democratic Party was pro-2nd Amendment, pro-patriotic American, and pro-Christian? Did you know that back in the 1950s-60s and before, they were all three of those things, but in the 1970s they began to change, when the socialists and communists started gaining power within their political party.

You see, the only groups that want to see the American people disarmed are those who wish to conquer us, and it has been aptly said that the USA could never be conquered from without, but only from within, hence the Democratic Party of today that is controlled solely by socialists and communists.

Only those who oppose what are 'Founding Fathers' set up and gave us as our heritage when they started the USA, the principles of a free market, free enterprise, and capitalism, and the only groups that oppose this heritage are the socialists and communists, hence the Democratic Party's attempt to disarm the American people by destroying our right guaranteed by the 2nd Amendment to the US Constitution, along with our rights of free speech and religious freedom, in the 1st Amendment.

Throughout history all socialists and communists have always been strictly against religion, for they never want the people to believe that their rights are unalienable endowed on them by their Creator (GOD), for they want the people to believe that the state only endows the rights that the people need, in order to keep the state above all else in the people's lives, and the socialists and communists will be the ones who run the state, and therefore we should be grateful to them for our rights, not our GOD.

If the state can take the place of GOD, then the people will worsghip and obey the state, and then those who run the state can do whatever they please, as they are the only ones that will ever benefit from those types of systems (Socialism & Communism), as the people suffer to provide the benefits for those who run the state. These are historical facts, and have been proven ever time in every socialist and/or communists state, down though history.

Back in the 1940s-50s my paternal and maternal families were all die hard Democrats, but very patriotic and very religious, and very pro-'Bill of Rights', all ten of them, but today none would have anything to do with the Democratic Party, and rightfully so.

Your correct again, and if they ever come to take my gun, I'll have the least deadly one set out and ready to give them, while the rest of all my guns will be well hidden in a safe place, but I'll be able to protect mysekf whereever I go with a concealed carry permit, as I legally walk the streets armed for my own protection, and for those in my general vacinity. Where I live you don't have to have a gun license, neither do you have to report which or how many guns you own, and concealed carry permits are easibly obtained. Florida is controlled by the Republicans, both houses of the state congress, as well as the governor, and heavily favors the 'Bill of Rights'.
